Important Considerations for Applicants to the January 2018 Rezone Cycle with FLUM Amendments

The City Commission adopted a new Transportation Element to the MCNP on December 14, 2017. This adoption was action taken through the Evaluation and Appraisal Review (EAR) process. The amendments to the Transportation Element were backed by data and analysis available for review here. The Mayor has signed off on the legislation and the Planning Department is preparing to submit the legislation and updated comprehensive plan to the Department of Economic Opportunity (DEO) for final review.

We expect the DEO to sign off on the new goals, objectives, and policies (GOPs) adopted on December 14 before the end of the month. For parties who are submitting applications to amend the Future Land Use Map (FLUM) in the January 2018 rezone cycle, we encourage you to consider the GOPs in the new update, available here in the strikethrough and underline format.

February 1, 2018 & November 28, 2018

On September 18, 2017, the Planning Department notified the State Land Planning Agency that it became necessary to extend the deadline for the adoption of the Transportation Element due to Hurricane Irma. The State Land Planning Agency acknowelegde this by letter on September 19.

  • February 1, 2018: This date was established as the date by which the Transportation Element would be adopted.
  • November 28, 2018: This date remains the date by which all other Elements would be adopted.

November 28, 2017 & November 28, 2018

On August 25, 2017, the Planning Department notified the State Land Planning Agency that it became necessary to seperate the adoption of the EAR-based amendments. The State Land Planning Agency acknowelegde this by letter on August 28.

  • November 28, 2017: This date was established as the date by which the Transportation Element would be adopted.
  • November 28, 2018: This date was established as the date by which all other Elements would be adopted.

November 28, 2017

As of June 5, 2017, this was the new deadline for the submission for the EAR-based amendments.

June 5, 2017

The City of Miami notified the State Land Planning Agency of its need to extend the 180-day deadline by an additional 140 days to November 28, 2017. This was acknowledged by the State Land Planning Agency and this date became the new deadline to adopt the EAR-based amendments.

January 12, 2017

The State Land Planning Agency sent its Objections, Recommendations, and Comments Report to the City. This gave the City 180 days (July 11, 2017) to respond to the report, incorporate the responses into the MCNP with revisions, and adopt those revisions for second reading. Upon adopting the revised EAR-based amendments at second reading, the City must transmit these changes to the State Land Planning Agency.

October 31, 2016

The City of Miami transmitted EAR-based amendments to the State Land Planning Agency by the deadline of November 1, 2016.

May 2016

November 1, 2015

According to Rule Chapter 73C-49 of the Florida Administrative Code, at least every seven years, on or before November 1, 2015, the City of Miami must notify the State Land Planning Agency by letter if it needs to amend the MCNP. This letter was sent accordingly.
